Once an insurance adjuster receives notice of a claim resulting from an accident, they usually will want to take your recorded statement.  Although the adjuster may make it seem like giving a statement is mandatory, there is no legal obligation for you to give one.

 

In most cases, there is nothing you can say that will help your case.  The accident report should be sufficient for the insurance company to make a decision on whether or not they will pay the claim.  Insurance adjusters will often try to reduce their liability by asking you questions such as “is there anything you could have done differently to avoid the accident.”  If you answer yes, even if the police officer determined the other driver to be at fault the adjuster may use this statement to justify reducing the amount of your recovery.
